Pennsylvania’s minimum automobile insurance coverage for damage to property is $5,000.00, a limit that was set by the State Legislature in the 1970’s. While this coverage may have been sufficient back then, it is woefully deficient in today’s world. Consequently, many auto accidents involve damages that far exceed the limits of a defendant’s coverage.

Historically, subrogating insurance carriers accepted these limits while leaving many dollars on the table. The current trend is for carriers to pursue defendants in litigation for the excess above the insurance limits.
